The Supreme Court has scheduled for review the Fundamental Rights (FR) petition submitted by ex-Minister Rajitha Senaratne, requesting a directive to reassess the preferential votes secured by the New Democratic Front’s (NDF) nominees for the Kalutara District in the 2024 General Election and announce updated results.
Accordingly, the FR petition is set for evaluation on 30 September 2025, following a ruling made by a three-judge panel of the Supreme Court, including Justices Preethi Padman Surasena, Janaka de Silva, and Sampath B. Abeykoon today (06).
The Election Commission and its officials, including its Chairperson, the Kalutara District Returning Officer, MP Rohitha Abeygunawardena (who won under the NDF in the 2024 General Election), and the Attorney General, have been listed as respondents in this case.
The petitioner asserts that discrepancies in the preferential vote-counting procedure in the Kalutara District during the previous General Election obstructed his opportunity to enter Parliament.
He highlights that the margin between him and the elected MP from the Kalutara District was merely 119 votes, and that this issue stemmed from those miscalculations.
The petitioner has additionally urged the Supreme Court to declare that his essential human rights were breached as a result and to direct the respondents to reassess the preferential votes gained by the NDF candidates in the Kalutara District during the last general election and publish corrected results.
Legal representatives, including Attorney-at-Law Keerthi Thilakarathne and President’s Counsel Faisz Musthapha, stood for the petitioner.
